Welcome to ZAIX DIGITAL! These Terms of Service (“Terms”, “Agreement”) govern your use of all products and services provided by ZAIX DIGITAL (“we”, “us”, or “our”) through our website, digital platforms, and communications.

By accessing or using any part of our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of this Agreement, you should not proceed with using our services.

1. About ZAIX DIGITAL

ZAIX DIGITAL is a creative agency providing high-quality social media content, growth strategy, design, and digital marketing services. We serve brands, creators, startups, and professionals looking to grow and maintain their digital presence across platforms such as Instagram, TikTok, Facebook, YouTube, and Google.

Our core offerings include:
• Monthly content packages 
• Video editing and branded reels
• Paid ads and performance marketing
• SEO content and blog services
• Personal and business branding assets

2. Who Can Use Our Services

To use ZAIX DIGITAL services, you must:
• Be at least 18 years old or the legal age of majority in your jurisdiction
• Have full authority to enter into a legally binding contract on behalf of yourself or your company
• Provide accurate and complete information when requested

3. Service Onboarding & Client Responsibilities

When you sign up for a ZAIX DIGITAL service:
• You’ll be contacted via email to initiate onboarding.
• You are expected to provide your brand information, social media links, goals, target audience, tone of voice, visual references, and any other relevant material.
• Our service delivery begins once all required materials have been submitted.

You are responsible for:
• Timely responses to content drafts and approval requests
• Providing accurate brand guidelines, assets, and creative direction
• Communicating delays or concerns proactively
• Reviewing and approving content within the agreed timeframe

Failure to communicate or provide required materials may delay service and does not qualify for a refund or credit.

4. Content Creation & Delivery

We create content based on your selected package and any custom brief you provide. We will:
• Produce image and/or video content according to your brand guidelines
• Deliver previews for approval (as outlined in your package)
• Offer a set number of revisions depending on your plan (e.g., 2–3 per post)

Revisions beyond your package limits will incur additional fees. Final content is delivered via shared folders or scheduled directly to your platforms (when authorized).

5. Subscription Plans & Pricing

ZAIX DIGITAL offers flexible monthly subscription plans:
• STANDARD – €99/month: Ideal for light engagement
• ADVANCE – €159/month: Balanced content & strategy
• PREMIUM – €199/month: Premium presence & growth
     •    ULTIMATE - €299/month:
Professional engagement & conversion

We also offer one-time or ongoing add-ons (e.g., Meta ads management, blog writing, SEO, rebranding). Pricing is displayed in Euros (€) and includes VAT where applicable.

All payments are billed in advance.

6. Billing & Payment
• Payments are processed securely via Stripe, PayPal, or other third-party platforms.
• Your subscription will renew automatically each month unless canceled.
• You are responsible for ensuring your billing details are up to date.

Late or failed payments may result in suspension of service. Continued unpaid balances beyond 10 days may result in cancellation of your subscription without notice.

7. Cancellation & Pausing

You can cancel your subscription at any time by contacting support@zaixdigital.com. To avoid being charged for the next billing cycle, you must cancel at least 7 business days before your due date. 

If you need to pause instead of canceling, we may offer account holds for up to 30 days depending on your case. Email us in advance to request a pause.

8. Refund Policy

Due to the creative and labor-intensive nature of our services, we maintain a strict no-refund policy once work has begun or content has been created.

You will not be eligible for a refund if:
• You change your mind or decide not to use the service
• You fail to provide the required assets or feedback in a timely manner
• You are dissatisfied due to personal taste preferences after revisions have been delivered
• Your social media results are not as expected (organic growth depends on platform algorithms and engagement)

We may consider partial refunds or account credits under the following conditions:
• You were charged in error and have not received any content or onboarding
• We failed to deliver your content after onboarding without valid explanation
• A service commitment (e.g., delivery timeframe) was not met due to fault on our side

Refund or credit requests must be submitted within 7 days of your billing date via support@zaixdigital.com. Requests outside this window will not be reviewed.

Refunds are not guaranteed and are approved only on a case-by-case basis at the discretion of ZAIX DIGITAL.

9. Ownership & Licensing

You retain ownership of any logos, photos, or branding assets you provide to us. We grant you full commercial use rights to the final content we deliver, once payment has been completed in full.

ZAIX DIGITAL retains the right to:
• Showcase finished content in our portfolio or case studies (unless you request otherwise)
• Reuse creative templates we develop in a non-identifiable way for future clients

You may not resell, sublicense, or redistribute our deliverables to third parties without permission.

10. Limitations of Service

We strive for quality and reliability, but:
• We do not guarantee specific performance results (e.g., follower growth, sales)
• We are not responsible for platform outages, algorithm changes, or account suspensions
• Our content strategy is optimized for general best practices, but every audience is different

We are a content and marketing partner—not a guarantee of success. Your growth depends on many factors including your engagement, product quality, audience size, and budget.

11. Prohibited Use

You may not use ZAIX DIGITAL to:
• Promote illegal, violent, or hateful content
• Infringe upon intellectual property rights
• Mislead your audience with false or deceptive advertising
• Engage in harassment, spam, or abusive practices

Violation of these rules may result in immediate termination of your account without refund.

12. Limitation of Liability

To the fullest extent permitted by law, ZAIX DIGITAL shall not be held liable for any indirect, incidental, special, or consequential damages arising from:
• The use or inability to use our services
• Delays or interruptions in service
• Loss of profits, revenue, or business opportunity

Our total liability shall not exceed the amount you paid us in the three (3) months prior to the claim.

13. Changes to These Terms

We reserve the right to update or change these Terms at any time. If material changes are made, we will notify you via email or post an update on our website. Continued use of our services after changes implies acceptance of the updated terms.

These Terms are governed by the laws of Spain. Any dispute or claim shall be exclusively handled in the courts of Madrid, Spain.
